Terms of USe

CITF Portal

This agreement (“Agreement”) applies as between you, the user of “CITF Portal” (“Application”) and Construction Industry Council (CIC), the owner of the Application. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon clicking the “I Agree” button of this Application immediately following the text of this Agreement. If you do not agree to be bound by these terms and conditions, you should not continue to use the Application.

Grant of Licence

The CIC hereby grants to you a personal, limited, non-exclusive, non-transferable, revocable licence to use of the Application exclusively by you and for your personal non-commercial use. This Agreement is effective until terminated. You may terminate this Agreement at any time by stopping using the Application.

Upon any termination, you agree to immediately destroy all copies of the Application, any accompanying documentation, and all other associated materials. The CIC reserves the right to terminate this Agreement at any time if you are in breach of any of the terms of this Agreement

The CIC may, at any time and without giving notice to you, make any change, correction and / or improvement to the Application, stop providing this Application or any feature of this Application to you or to users generally, or impose usage limits for the Application.

Ownership of the Application

Notwithstanding the grant to you of a license to use the Application pursuant to this Agreement, the CIC retains all right, title and interest (including intellectual property rights) on all text, graphic images, logos, icons, sound clips, video clips, data compilations, page layout, underlying code (including object and source codes), software and any other materials in and to the Application. Any act of “mirroring” the Application or the materials contained therein on any device and/or server without the prior written permission of CIC, or modifying or reusing the text or graphics on the Application is prohibited. The CIC reserves all rights not expressly granted under this Agreement.

You will not, nor allow third parties to (i) make and distribute copies of the Application (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever.

>Username and Password

You are required to create a user account to use the Application, the user name and password will be decided on your own. You undertake to keep the password and the username as confidential information and will not disclose any of this information to any other person under any circumstances. You agree and acknowledge that any use of the Application by any person whatsoever (whether authorized by you or not) with your password and username shall constitute and be deemed the use of the Application by you. You shall be held solely and fully liable to the CIC for any loss and damages arising from your disclosure (whether intentionally or unintentionally) and any authorized and/or unauthorized use of your password and username.

Personal Information Collection Statement

Collection of Personal Data

The information you provide to the Construction Industry Council, its affiliates, and / or its subsidiaries, including, but not limited to, the Hong Kong Institute of Construction and Zero Carbon Building, Construction Sector Imported Labour Quarters Limited (collectively, the “CIC”), including any personal data as defined in the Personal Data (Privacy) Ordinance (Cap.486), will be used solely for purposes related to the activities of the CIC. The activity and the required personal data are detailed in the application form.

Whether or not you provide your personal data to the CIC is voluntary. However, where you are providing information for the purpose of an application, it is necessary that you supply the CIC with complete information as specified on the application form. Otherwise, the CIC may be unable to process or consider your application. If you are under the age of 18, you should consult your parent or guardian before providing any personal data to us.

You are entitled to request access to and correction of any errors in your personal data. Purposes of Collection

Your personal data will be kept confidential and may be used by the CIC for the following purposes:

  1. Assessing your CITF application
  2. Serving as reference materials of the construction industry for the purpose of promoting technology adoption and the CITF. The Approved Project information (including but not limited to photos, PowerPoints, completion reports or videos submitted with the application) will be published on CITF public domain, including CITF website, seminar, or other promotional materials for public information;
  3. Performing analysis and conducting research and surveys;
  4. Facilitating communication with you;
  5. Performing and exercising functions and powers of the CIC under relevant legislation, rules, and sub-legislation, including but not limited to the Construction Industry Council Ordinance (Cap.  587) and Construction Workers Registration Ordinance (Cap. 583);
  6. Establishing, exercising and defending the CIC’s legal rights, and complying with the CIC’s legal and regulatory obligations (including anti-money laundering obligations, complying with orders by courts or regulators, etc.);
  7. Managing access to the CIC’s premises and for security purposes;
  8. Preventing and responding to actual or potential security threats, fraud or illegal activities;
  9. Handling complaints or enquiries;
  10. Performing audits and compliance reviews to ensure compliance with the applicable CIC’s policies and procedures, regulations and law;
  11. Other purposes related or incidental to the conduct of the CIC’s activities; and
  12. Any other purposes that you may consent to from time to time.

Points to Notes

Where your CITF application has been approved, the Approved Project information (including but not limited to the names of the Successful Applicant, grant funding amount, title of the Approved Project and type(s) of technology adopted) will be published on CITF Website for public information.

It is obligatory for you to provide the CIC with your personal data for publishing. Otherwise, we will not be able to process or consider your application.

Disclosure and Transfer of Personal Data

The CIC may disclose or transfer your personal data for the purposes as stated in paragraph 2 to third parties, including but not limited to the following:

  1. Any or all of the CIC’s affiliates and/or subsidiaries;
  2. Any third party service providers, contractors/sub-contractors that, on behalf of the CIC, operate or maintain membership, event registration, tour booking, researches and/or analysis, or carry out back-end services, administrative services, verification services, cloud services or information technology services, or provide necessary support or services to the CIC to enable us to provide our services, including any insurance, banking or third party payment gateways services used by the CIC, and any other entities that discharge contractual obligations on our behalf;
  3. Any of the CIC’s professional advisors, including but not limited to lawyers, accountants and auditors; or
  4. Any party that owes a duty of confidentiality to the CIC.

Use of Personal Data Related to Direct Marketing

To keep you informed of CIC activities and developments in the construction industry which may be of interest, the CIC would like to use your personal data, including your name, phone number, correspondence and email address, to update you in relation to CIC training courses, trade testing, registration, events and other aspects of its work and developments in the construction industry. You are free to decide whether you wish to receive such information. If you choose not to receive information on the above, please put a tick in the box below. You may make any subsequent changes on your choice of receiving promotional materials by writing to us.

Links and information

The Application may contain links to other websites, applications, platforms and / or resources provided by third parties. These links are provided for your information and / or easy access only. The CIC has no control over the contents of those sites or resources or information and accept no responsibility for them or for any direct or indirect loss or damage that may arise from use of such links and information.

Disclaimers

While the CIC endeavours to ensure the accuracy of the information in the Application, no express or implied warranty is given by the CIC as to the accuracy of any part of the information. The CIC shall not be liable for loss or any damage (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from the use of or inability to use the Application, or any information or link contained in it, or from any action or decision taken as a result of using the Application or any such information or link.

The CIC does not warrant that the functions contained in the Application will be uninterrupted or free of defects and / or faults, nor the Application and its related programmes will be compatible with all equipment (hardware or software) which you may use. You agree that CIC shall have no liability in relation to any direct or indirect loss and damage caused to the relevant device or information contained in the device.

The CIC may revise at any time without prior notice to you. Some of the provisions contained in this Agreement may also be superseded by provisions or notices published in the Application. Your continued use of the Application after any changes to this Agreement will constitute your acceptance of such change. If you do not agree with any changes or additions the CIC makes, you are to immediately terminate this Agreement by stopping using the Application.

Governing Law and Jurisdiction

This Agreement will be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.

Language

In the event that there is any inconsistency between the English and Chinese versions of this Agreement, the English version shall prevail.
